PLAINTIFF in error, defendant below, was charged with the crime of murder. In the first instance he entered a plea of not guilty by reason of insanity at the time of the alleged commission of the offense and since, but upon trial at the conclusion of the peoples evidence the plea first made was withdrawn and a plea of "not guilty" interposed upon which the case was submitted. The jury found the defendant guilty of murder in the first degree, fixing the penalty for the crime at death and judgment was entered accordingly.
